2. Services Description
Cyrus Construction provides residential and commercial construction services throughout Greater Northeast Ohio, including but not limited to:
- Storm damage repair and restoration
- Water damage mitigation
- Kitchen and bathroom remodeling
- Finished basements
- Siding and window installation and replacement
- Pole barn construction
- Emergency repair services
- General remodeling and construction
- VA and FHA home inspections and repairs
The specific scope, pricing, and timeline of any project will be defined in a separate written contract or agreement between you and Cyrus Construction.
3. Quotes and Estimates
All quotes and estimates provided by Cyrus Construction are non-binding and subject to change. Quotes are provided as good-faith approximations based on the information available at the time of the estimate. Final pricing may differ after:
- A thorough on-site inspection reveals conditions not visible or apparent during the initial assessment (including hidden water damage, structural issues, mold, asbestos, or other concealed conditions).
- Material costs fluctuate due to market conditions, supply chain disruptions, or manufacturer price changes.
- The scope of work changes at the client's request or due to unforeseen site conditions.
- Building code requirements or permit conditions require additional work beyond the original scope.
- Environmental factors or site conditions require specialized remediation or preparation before construction can proceed.
Quotes provided through the website, phone, email, or AI Vision Tool are preliminary and for informational purposes only. A binding price will only be established through a signed written contract following an on-site inspection.
4. Contracts and Agreements
All construction projects undertaken by Cyrus Construction will be governed by a separate written contract that will include, at minimum:
- Detailed scope of work and project specifications
- Agreed-upon pricing and payment schedule
- Estimated project timeline and milestones
- Material specifications and selections
- Warranty terms applicable to the specific project
- Change order procedures and approval requirements
4.1 Change Orders
Any modifications to the agreed-upon scope of work must be documented through a written change order signed by both parties. Change orders may affect the project price, timeline, or both. Cyrus Construction will not proceed with changes to the scope of work without a signed change order, except in cases of emergency where immediate action is required to prevent property damage or safety hazards.
4.2 Material Selections
Clients are responsible for timely material selections. Delays in material selections may result in project timeline extensions. If selected materials become unavailable, Cyrus Construction will work with you to identify suitable alternatives at comparable pricing.
5. Payment Terms
Payment terms will be outlined in your project contract. In general:
- A deposit may be required prior to the commencement of work, as specified in the project contract.
- Progress payments may be due at specific project milestones as outlined in the contract.
- Final payment is due upon substantial completion of the project and your walkthrough approval.
- Late payments may be subject to interest charges or service fees as outlined in the contract.
- Accepted payment methods will be specified in the project contract.
Cyrus Construction reserves the right to suspend work if payments are not received according to the agreed schedule.
6. Insurance Claims Process
For storm damage, water damage, and other insured events, Cyrus Construction can work directly with your insurance company. Please note:
- We will prepare damage assessments, documentation, and repair estimates to submit to your insurance carrier.
- We assist in the claims process but are not responsible for insurance claim outcomes, coverage decisions, or reimbursement amounts determined by your insurer.
- You remain responsible for any deductibles, non-covered items, or amounts not paid by your insurance company.
- Additional work beyond what is covered by insurance will be documented and priced separately for your approval.
- We recommend filing claims promptly, as delays may affect coverage eligibility.
7. Warranty and Guarantees
7.1 Workmanship Standards
Cyrus Construction is committed to delivering high-quality workmanship on every project. All work is performed in accordance with applicable building codes, manufacturer installation guidelines, and industry best practices.
7.2 Workmanship Warranty
Specific warranty terms for workmanship will be outlined in your project contract. Warranties cover defects in workmanship and do not extend to normal wear and tear, damage caused by the homeowner or third parties, acts of nature, or failure to maintain the work as recommended.
7.3 Material Warranties
Materials used in your project may carry separate manufacturer warranties. Cyrus Construction will provide applicable manufacturer warranty documentation upon project completion. Claims under manufacturer warranties are subject to the manufacturer's terms and conditions.
7.4 Warranty Exclusions
Warranties do not cover:
- Damage caused by subsequent modifications performed by others
- Damage resulting from failure to follow maintenance recommendations
- Damage from natural disasters, acts of God, or extraordinary events
- Normal settling, shrinkage, or expansion of materials
- Pre-existing conditions not included in the original scope of work
8. Limitation of Liability
To the fullest extent permitted by Ohio law, Cyrus Construction's total liability for any claim arising out of or related to our services shall not exceed the total amount paid by the client for the specific project giving rise to the claim.
Cyrus Construction shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of use, loss of income, or loss of anticipated savings, regardless of the theory of liability.
This limitation does not apply to claims arising from gross negligence, willful misconduct, or fraud.
9. AI Vision Tool Disclaimer
Our AI Vision Tool allows you to upload photos of your property and receive AI-generated visualizations of potential remodeling or renovation outcomes. By using this tool, you acknowledge and agree that:
- Visualizations are approximations only and are not guarantees of actual results. AI-generated images are artistic renderings intended to provide a general idea of possibilities, not exact representations of what the finished project will look like.
- Actual results may vary significantly due to material properties, lighting conditions, structural constraints, building code requirements, and other real-world factors.
- The AI Vision Tool does not constitute a professional design consultation, engineering assessment, or structural evaluation.
- Color accuracy in AI-generated images may differ from actual material colors due to screen display variations, AI interpretation, and manufacturing differences.
- Cyrus Construction makes no warranties regarding the accuracy, completeness, or reliability of AI-generated visualizations.
- The tool is provided as a complimentary service for exploratory purposes and should not be relied upon as the sole basis for making remodeling decisions.
10. Website Use
When using our website, you agree not to:
- Use the website for any unlawful purpose or in violation of any applicable local, state, or federal law.
- Upload malicious content, viruses, or harmful code through our contact form, AI Vision Tool, or chatbot.
- Attempt to gain unauthorized access to any portion of the website, server, or connected systems.
- Use automated tools, bots, or scrapers to access or collect data from the website without written permission.
- Submit false, misleading, or fraudulent information through any form or tool on the website.
- Interfere with or disrupt the website's functionality or the experience of other users.
- Upload images through the AI Vision Tool that you do not have the right to use or that contain inappropriate content.
11. Intellectual Property
All content on this website, including text, graphics, logos, images, page layouts, and software, is the property of Cyrus Construction or its content suppliers and is protected by United States and international copyright laws.
Project photos, before-and-after images, and other visual content displayed on our website remain the property of Cyrus Construction unless otherwise noted. With your permission, we may use photos of completed projects for portfolio and marketing purposes.
AI-generated visualizations created through our Vision Tool are provided for your personal use in evaluating potential projects with Cyrus Construction and may not be used for commercial purposes or provided to competing contractors.
12. Project Timelines and Delays
Cyrus Construction strives to complete all projects within the estimated timeline. However, project timelines are estimates and may be affected by:
- Weather Delays: Exterior work (roofing, siding, windows, pole barns) is subject to delays caused by rain, snow, extreme temperatures, and other adverse weather conditions common in Northeast Ohio.
- Material Availability: Supply chain disruptions, manufacturer backorders, or shipping delays may impact material delivery and project schedules.
- Permit Processing: Timelines for obtaining building permits vary by municipality and are outside of Cyrus Construction's control.
- Inspection Scheduling: Required building inspections are scheduled through local authorities and may cause delays if inspectors are unavailable.
- Unforeseen Conditions: Discovery of hidden damage, structural issues, mold, asbestos, or other concealed conditions during construction may require additional time to address.
- Client-Requested Changes: Change orders and modifications to the original scope will impact the project timeline.
- Insurance Approval Delays: For insurance-funded projects, delays in claim approval or supplement processing may affect project scheduling.
Cyrus Construction will communicate any anticipated delays promptly and work to minimize their impact on your project.
13. Permits and Inspections
Many construction and remodeling projects require building permits and inspections by local authorities. Cyrus Construction will:
- Advise you on permit requirements for your specific project.
- Obtain necessary permits on your behalf as part of the project scope, unless otherwise agreed.
- Schedule and coordinate required inspections with local building departments.
- Ensure all work complies with applicable building codes and regulations.
Permit fees are typically included in the project cost unless otherwise specified. The client is responsible for providing accurate property information required for permit applications. Failure to obtain required permits or pass inspections due to pre-existing conditions or client-directed changes may result in additional costs.
14. Property Access
By engaging Cyrus Construction for a project, you agree to provide reasonable access to the work area, including:
- Clear and safe access to the project area and surrounding property as needed for construction activities.
- Access to utilities (electrical, water, and plumbing) as required for the project.
- A reasonably clear work area, with personal belongings removed from construction zones as requested.
- Access for material deliveries, equipment staging, and debris removal.
- Arrangements for access when you are not present, if applicable and mutually agreed upon.
Cyrus Construction will treat your property with respect, take reasonable precautions to protect non-work areas, and clean up the work area at the end of each workday.
15. Dispute Resolution
These Terms and any disputes arising from your use of our website or services shall be governed by the laws of the State of Ohio, without regard to its conflict of law provisions.
In the event of a dispute, both parties agree to first attempt to resolve the matter through good-faith negotiation. If a resolution cannot be reached through negotiation, the parties agree to submit the dispute to mediation before pursuing any other form of dispute resolution.
If mediation is unsuccessful, either party may pursue resolution through binding arbitration or litigation in the courts of the State of Ohio. The prevailing party in any dispute resolution proceeding may be entitled to recover reasonable attorney's fees and costs.
16. Force Majeure
Cyrus Construction shall not be held liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to:
- Natural disasters, severe weather events, floods, or earthquakes
- Pandemics, epidemics, or public health emergencies
- Government actions, regulations, embargoes, or sanctions
- Material shortages, supply chain disruptions, or manufacturer shutdowns
- Labor disputes, strikes, or workforce shortages
- Utility failures or infrastructure disruptions
- Acts of war, terrorism, or civil unrest
In the event of a force majeure occurrence, project timelines will be extended by a period equal to the duration of the delay, and both parties will work together in good faith to minimize the impact.
17. Termination
Cyrus Construction reserves the right to refuse or terminate services at our discretion for any lawful reason, including but not limited to:
- Non-payment or failure to adhere to payment terms
- Unsafe working conditions created or maintained by the client
- Misrepresentation of project scope, property conditions, or ownership
- Abusive or threatening behavior toward our team
- Violation of these Terms of Service
If a project is terminated by the client after work has commenced, the client shall be responsible for payment of all work completed, materials ordered or purchased, and any reasonable costs incurred. If a project is terminated by Cyrus Construction due to client breach, the same payment obligations apply.
We may also terminate or suspend access to our website at any time without notice for conduct that we believe violates these Terms or is harmful to other users or our business interests.
18. Changes to These Terms
We may update these Terms of Service from time to time. Any changes will be posted on this page with a revised “Last Updated” date. Your continued use of our website after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

19.4 Message and Data Rates
Message and data rates may apply. Standard messaging and data rates from your wireless carrier apply to all SMS/MMS messages sent to and received from Cyrus Construction. Check with your mobile carrier for details about your text messaging plan.
19.5 Opt-Out
You may opt out of receiving text messages from Cyrus Construction at any time by replying STOP to any message you receive from us. After opting out, you will receive a one-time confirmation message acknowledging your request. No further messages will be sent unless you re-subscribe. Your phone number and SMS data are handled in accordance with our Privacy Policy. We do not sell, rent, or share your phone number or SMS opt-in data with third parties for their marketing purposes. Phone numbers collected for SMS communications are used solely by Cyrus Construction and our SMS service provider (Twilio) to deliver messages on our behalf.
